Fraud Prevention and Bot Activity Policy

At Tracy Mccrackin Photography, we are committed to providing a secure and trustworthy shopping experience for all our customers. To ensure the integrity of our platform, we have established the following policies to prevent fraudulent and unauthorized activities:

Acceptance of Terms

By completing your purchase on this website, you confirm that:

  • You are the authorized user of the payment method provided.  
  •  You have reviewed and agreed to our Terms and Conditions and this Fraud Prevention and Bot Activity Policy.  Located in the Header and Footer of this Website.
  • Violations of these policies may result in immediate action, including account termination and legal consequences.

Prohibition of Automated Activity

The use of bots, automated software, or any unauthorized tools to interact with our website is strictly prohibited. Any orders placed through such means will be canceled immediately.

Monitoring and Detection

We actively now monitor all activities on our website using advanced fraud detection systems, CAPTCHA verifications, and manual reviews of suspicious orders. Any unauthorized or suspicious activity will be flagged for investigation. URLS are saved.

Zero Pricing Policy

There are no products available for $0 on our website. Any orders placed with a $0 value will be automatically canceled for Fraud, and the customer will be permanently blocked from making further purchases.

Chargebacks and Unauthorized Transactions

We are committed to maintaining a secure and trustworthy shopping experience for all our customers. As part of this commitment, we take fraudulent transactions very seriously.

  • Chargebacks for services or products received are considered fraudulent and will be disputed to the fullest extent. 
  • Tracy Mccrackin Photography is not responsible for chargebacks resulting from fraudulent purchases made using stolen or unauthorized accounts. It is the account holder's responsibility to secure their payment information.
  • We reserve the right to pursue legal action to recover losses incurred from fraudulent chargebacks.

Non-Refundable Fraudulent Purchases

  • No Refunds for Fraudulent Purchases: Purchases that are identified as fraudulent or made with unauthorized payment methods (e.g., stolen credit cards, unauthorized use of accounts, etc) will NOT be eligible for a refund. We reserve the right to cancel such transactions immediately to prevent further misuse.
  • Transaction Review Process:  If fraud is suspected during or after a transaction, the purchase will be flagged for investigation. This may involve consulting with our payment processors and verifying details with the legitimate account holder. If fraud is confirmed, the order will be canceled without further notice.
  • Reporting to Authorities: In cases of confirmed fraud, we reserve the right to report the incident, including all relevant transaction details, URL pages, to the appropriate authorities and payment processors for further investigation and enforcement.
  • Customer Notification: If a legitimate transaction is mistakenly flagged as fraudulent, we will contact the purchaser to resolve the issue promptly. Please ensure that all billing information provided at checkout is accurate and matches the details on file with your payment provider. Verification typically takes an additional 5 business days. However, in cases where further investigation is required, this period may be extended. We will notify customers of any significant delays beyond this timeframe.
  • Order Cancellations: If we are unable to verify the payment method within the verification period, we may cancel the order and there is NO refund as this is suspected to be a fraudulent purchase.

Legal Action Against Violations

Any individual or entity found engaging in fraudulent activity, bot usage, or unauthorized transactions will face legal consequences. This may include, but is not limited to, filing lawsuits or reporting violations to appropriate authorities.

Order Cancellation and Account Ban

We reserve the right to cancel any order and permanently ban any account associated with fraudulent or unauthorized activity. This includes attempts to place orders for $0 items or abuse of our systems.

Cooperation with Authorities: In cases of fraud, we will fully cooperate with law enforcement agencies to ensure violators are held accountable. Unauthorized transactions will be reported to the relevant authorities. 

Secure Transactions and Identity Verification: We use secure payment gateways with fraud detection mechanisms. For high-value or suspicious transactions, we may request additional identity verification. Failure to comply may result in order cancellation.

No Tolerance for Fraud: We have a zero-tolerance policy for any activity that compromises the safety or integrity of our platform or customers. Fraudulent activities will be swiftly and thoroughly addressed.

Non-Liability for Fraudulent Purchases:  Tracy Mccrackin Photography is not liable for any losses or damages arising from fraudulent transactions, including the use of stolen payment methods or accounts. It is your responsibility to ensure the security of your payment details.

Updates to Policy:  We reserve the right to update or amend this policy at any time to address evolving security threats and to ensure the safety and integrity of our platform. This policy is designed to safeguard our valued customers and ensure a secure shopping environment for everyone.
